Story of a Complaint: Payment in lieu of vacation (27.3.23)

An employer failed to give an employee payment in lieu of vacation - following the intervention of Office of the Ombudsman the complainant received the payment after five years


Upon termination of the work relations between an employee and an employer, the employee is entitled to receive from the employer payment for accrued unused vacation . The employee should receive the payment automatically upon the termination of employment.

The Office of the Ombudsman received the complaint of a man who had worked for about a year at a local council and had not received payment in lieu of vacation upon termination of his employment. According to the complainant, only some five years after terminating his said employment did he find out that he had been entitled to payment in lieu of vacation. He therefore asked the council to pay him the money owing to him. The council failed to respond, and the complainant therefore contacted the Office of the Ombudsman.

Following the Office's inquiry, the council reconsidered the complainant's request. After the complainant presented the documents required by the council, the payment was approved and the sum of NIS 3,900 was paid to the complainant, in lieu of his unused vacation days.
