Protection of Whistleblowers

Sections 45A - 45C of the State Comptroller Law empower the State Comptroller and Ombudsman to investigate complaints of employees who have been harmed for exposing acts of corruption within their organization

Sections 45A - 45C of the State Comptroller Law empower the State Comptroller and Ombudsman to investigate complaints filed by employees who have been victimized for exposing acts of corruption within the organization in which they work and to make provisional or permanent orders in order to protect the rights of such employees.  These sections also empower the Ombudsman to protect the internal auditor of an audited body against measures taken against him in reaction to his activities in fulfilling his function.

In order for such a complaint to be investigated, it must satisfy all the conditions laid down in Section 45A of the Law.  Where this is found to be the case, the Ombudsman may issue a protection order under Section 45C of the Law.

Under Section 45F of the Law, audited bodies are obliged to publicize in a prominent place within the organization, a notice worded in accordance with the Ombudsman's directives, setting out the main provisions of the Law regarding the protection of whistleblowers.
